To carry out highway works to comply with planning permission, you must enter into an agreement with us.
The highway includes:
- carriageway
- footway
- verge and any other area between highway boundaries
The types of agreement to cover different levels of improvement works are:
- a minor works permit for minimal works that do not involve electrical works
- a unilateral agreement for minimal works that do involve electrical works
- a Section 278 agreement for all other works
Minor works permit
To carry out highway works to comply with planning permission, you must enter into an agreement with us.
A minor works permit is for minimal works that do not involve electrical works.
Before you start any works, you must have a minor works letter and permit signed by us.
Approval process
- Contact us by emailing developmentmanagement@lincolnshire.gov.uk or call 01522 78270 to request the permit. We will then assess your request.
- If approved, we will post your permit to you.
- Work can only begin when you have received your permit.
Refused applications
If we cannot resolve any issues, we will refuse your application. We will return your paperwork.
Unilateral agreement
To carry out highway works to comply with planning permission, you must enter into an agreement with us.
A unilateral agreement is for minimal works that do involve electrical works.
You will agree to pay us to carry out the works through our term maintenance contractor. It is only available where we have sufficient capacity.
Before you start any works, you must have a unilateral agreement letter and permit signed by us.
Approval process

- If approved, we will post your permit to you.
- Work can only begin when you have received your permit.
Refused applications
If we cannot resolve any issues, we will refuse your application. We will return your paperwork.
Section 278 agreement
To carry out highway works to comply with planning permission, you must enter into an agreement with us.
For highway improvements where the Minor Works Permit or Unilateral Agreement is not appropriate, we require a Section 278 agreement.
You must employ a designer and contractor, as well as provide a bond. We will initially send you a Section 278 Agreement for Works letter.

All Section 278 works in Lincolnshire must be designed and constructed using the following:
Commuted sums for maintenance will be charged through either:
- itemised lists according to asset type or
- calculated on the basis of maintenance and replacement costs of the asset
Where calculated, commuted sums shall be in line with Lincolnshire's prevailing method of calculation, which will reflect national guidance and best practice
